Stage Of Litigation Against State Bank of India

Concerned Department: SBI, Raila Branch, Distt. Bhilwara.

 Particulars of Accounts: Ref: – Loan Account No’s. (i) 30790086642 (TL Account); (ii) 30790105601 (TL Account) and (iii) 30790238803 (CC Limit) M/s Rosebay Agro Farms Pvt. Ltd. from  Raila, Distt. Bhilwara Branch.   

 Since Jan. 2009 to May 2011 we approached various forums like Chief Manager, Asstt. General Manager & General Manager but no remedial action was taken by any one. Finally we inform the entire problems in detail to:-

 

1.The Chairman,

State Bank of India,

State Bank Bhawan,

4th Floor, Nariman Point,

Mumbai-400021.

 

We filled a compliant on dated 31.05.2011 followed by our reminder letters dated 16.06.2011, 08.07.2011, 12.07.2011, 26.07.2011, 03.08.2011, 10.08.2011, 16.01.2012, 28.01.2012 & 06.02.2012.

 

No action was taken by them, we are also not aware about any investigation & fate of our complaint also.

 

2. The Central Vigilance Commission,

Section Officer, VIG- III,

SatarktaBhawan, G.P.O. Complex,

Block A, INA,

New Delhi- 110023.

 

We have filed a complaint on dtd. 25.01.12& received a letter from them on dtd. 28.03.12 making direction to C.V.O. S.B.I. Mumbai for investigation & report but no action has been taken by CVO, SBI, Mumbai. We reminded on dtd. 22.08.2012 & 29.10.2012 & 13.12.2012 also.

 

3. Chief Vigilance Officer,

Reserve Bank of India,

Central Office, 16^th floor, Shahid Bhagat Singh Marg,

MUMBAI-400 001

We have filed a complaint on dtd. 08.06.12 & received a letter on dtd. 10.07.12, they merely forwarded our complaint to The C.V.O., S.B.I., Mumbai, to resolve at their end. Even C.V.O., RBI is the most competent authority to take appropriate action. Here CVO, SBI, Mumbai has not taken action on it yet.

 

4. Chief Vigilance Officer,

State Bank of India,

We have filed a complaint on dtd.25.01.12& reminder on dtd. 04.04.12. & 22.08.12 & 29.10.2012 & 13.12.2012 unfortunately we have not received any receipt no. of our complaint even after all the above (2&3) both authorities had given direction to him.

 

The CVO of any bank is appointed by The RBI as an independent authority to investigate fair & transparent all the complaints they received. But in our case 9 months have been passed & nothing happened.

 

5. Office of the Banking Ombudsman

Reserve Bank of India Building,

4^th Floor, Rambagh Circle,

Jaipur

They decline our complaint on the basis that Bank has filled a case. In fact no case has been filled by Bank till 31.07.12. Even it happen still we have right to get investigation for the same. The Banking Ombudsman has taken a U TURN to save bank officials.

 Procedures: After getting complaint he must deliver within 15 days to the concerned bank / Officials. Within 15 days from that the bank should file their reply & soon Banking Ombudsman received, it will deliver to the complainant for his rejoinder. In all total proceedings must be completed within 45 days. Banking Ombudsman should pass an order in next 15 days. It means Banking Ombudsman has done nothing upto 54 days to save guard the accused official because they all know the Laguna that after filling case into DRT they will all be safeguarded by that LAW

Finally we went to the honorable high court for proper relief.

PRAYER: Issue appropriate direction to The Banking Ombudsman Jaipur or CVO, SBI, Mumbai to faire enquiry along with provide all information we sought under RTI.
